What says the brain trust?

ProSeries : 2011

A friend showed me his return after a small disagreement. He owns a 2 family, 1/2 owner occupied.... His CPA(?) has been showing the rental income on 1040 line 21. No sch E.... When TP told his preparer that I said he should amend last 3 years, he was told something about how that would hurt him if he ever sells the property...

The house was bought 4years ago and put in service (after fixing up rental apt) 3 years ago... Rental income around 12k/year... Due to recession, current market value of house is approx 80% of purchase price....

I just want to show him some 2nd opinions because he has a lot of faith in his CPA(?).

I'd rather be flying........

Tell him those CPAs are nothing but a bunch of idiots.  Wait a second, on second thought maybe I should limit that reponse to those CPAs out east.  If you are looking for a second opinion that the CPA messed things up on those returns, consider this a second to your motion.

I'm not at all sure what that means, but If it means what I think it means, the term "allowed or allowable" comes to mind.  I can't think of how else he could be "hurt," and he's clearly missing a LOT of deductions.  Or is he showing net rental income on line 21?

Morons. I've got MORONS on my team. Nobody is going to rob us going DOWN the mountain. We have got no MONEY going DOWN the mountain. When we HAVE GOT the money, goin' back UP the mountain, THEN you can sweat.

He's only showing rental income on line 21... no expenses... nada... the CPA(?) is apparently referring to how a depreciation deduction erodes the basis. The CPA(?) did tell TP that he did get a full deduction for taxes and mortgage int on Sch A...  :-)

Those bloody CPA's. He is doing his client a disservice, not only on the allowed or allowable that Archie pointed out, but paying tax on income that should be reduced by the expenses  he paid.

What facts are we missing?  Is this a below FMV rental?  Related party?  Not rented for profit?

See Pub 17 Chapter 9:

Where to report.    Report your not-for-profit rental income on Form 1040, line 21. For example, you can include your mortgage interest and any qualified mortgage insurance premiums (if you use the property as your main home or second home), real estate taxes, and casualty losses on the appropriate lines of Form 1040, Schedule A, if you itemize your deductions.

Rick.... you're not missing anything...FMV, arms length...  this is about as straight forward as it gets... TP pays utilities, repairs, insurance, etc... no deductions no depreciation... only reporting rental income on line 21....  Other than that TP has 60K W2 income from S corp, and 5K Sch E pg 2 from K1... and I really rather not look at the 1120s.

This aint rocket science.... but TP has a lot of confidence in his preparer and you can probably guess what I think of him.  TP is a friend, not a client... and I really don't want him for a client.... but he's leaving a lot of $$ on the table and he needs to hear it from someone else.

Will he allow you to recalculate one of his returns?  That way, you could tell us what you did, we could check it, and you could take it back to him "signed off" by a dozen or so of us.

add me to the list--perhaps the acid test would be for your friend to ask how they would handle the sale of the property-especially since he has a capital loss he apparently "can't take"-

agree should be on rental E and take the expenses
