New US Resident

ProSeries

I have a couple that has been married many years (married in Sudan Africa), husband moved to USA at least 10 years ago, wife did not want to come. She finally joins him in 2011. She has a SS# that she just obtained in 2011. His taxes have been file head of household (becasue he came with his son as a dependent). So for 2011, I'm filing him MFJ, he wishes to amend his taxes back as far as he can go to MFJ. Can this be done seeing as she just became a US resident in 2011?

The solution

Yes, provided they include all of their worldwide income. They can refunds for tax years 2008, 2009 and 2010.

When anyone doing nothing needs help, I will gladly help that person do nothing.

I used the word CAN, not will or even might. They cannot get refunds for earlier years. If they would owe for any year on a amended return, I would no amend that year, since even though they were allowed to file jointly they were not required to do so.
