New 1040X Form not available on 2008 program?

Lacerte

The new 1040X form (revised 2010) that is available on the 2009 program is not available on the 2008 program. I contacted support, they told me you can use the 2008 (or earlier program ) to amended 2008 or prior returns. Because the Old Form 1040X (Feb 2009) will print, which they said the IRS wont except. They told me I must manually re-input the 2008 into the 2009 1040X along with changes to get the correct form.

Has anyone had any experience with this?

You heard the same thing the rest of us did.

If you use Pro Series Basic I might not be able to help you. If you use Turbo Tax I might refuse to help you. All others, watch out! ;-)

But somehow I heard that IRS will accept old forms for old returns.  Was I wrong?  Hope not; I just amended someone's '08 return using the '08 form.

I have heard both ways so who really knows, I guess once the IRS makes their mind up we will find out for sure

Since most of us will probably need to prepare amended 08 returns at some time, is it too much to expect Lacerte to update the 1040X Form?

Apparently it is too much to expect.  I have requested this for other years and was told they do not do that in prior year programs.

When Intuit requested guidance from the IRS earlier this year, we received the following:

For any year’s amended return, the revision of Form 1040X that first covered that year, the revision prior to that one, and any subsequent revision can all be used to amend that year’s return, regardless of when it is filed. So, for example, the February 2009 revision could be used to amend a 2009 return in March 2013, or even later, and it could be used to amend a 2006 return in early April 2010 or later. And the January/February 2010, 2011, 2012, or 2013 revision of Form 1040X could also be used to amend that 2009 return, in addition to the February 2009 revision.

Thanks for the info Dave.  I had always thought you had  to use the most recent version of 1040X or IRS rejected it.  I had heard otherwise, but only through the grapevine, not from the IRS.

Wonderful!  So my client whose 1040X of '08 I did recently (using the version that's on the '08 Lacerte program), getting them a $2800 refund, will presumably go thru uninterruptedly (if there's such a word).

Dave, would you have a copy of the guidance?  

The reason of asking is because I just called the IRS & they said as follows: 

 “the guidelines say you Must use the new form revised 2010”

 

I told him there was questions weather or not it was necessary and he said that "the problem is you are at the mercy of the IRS processor, that you might get a processor who will say ok, and just pass it thought, but they are supposed to reject it and many many of the processors will. The guidelines are very clear that you must use the new form."
