Midwest Disaster relief clarification

Lacerte : 2008

I think the Heartland Disaster Tax Relief Act of 2008 does allow the net disaster loss from a midwest disaster to be eligible for the standard deduction add on and other speical disaster issues. The form instructions would lead you to believe otherwise but I recommend you check further.

In my experience, Lacerte follows the plain language of the forms instructions, even when not everyone agrees that the forms instructions follow the statutes / case law / regs / whathaveyou.

After struggling with this issue and even checking with the RIA Checkpoint editor, I am now resolved that the midwest disaster relief does not include the standard deduction add on.
