LLC or Sole Proprietor ?

We (husband and wife) are in the process of buying a single family home as an investment property with the intend to rent it out. We will have a mortgage and probably a negative cash flow.My husband is going to do the property management and all maintenance work plus finish the basement. 1.)Should we create an LLC which gives us more protection against loss of our other assets or should we operate it as a sole proprietor? 2.) Can husband and wife, which will be owners of the LLC file their taxes as a sole proprietor as long as they file a joint tax return? Or will it be considered a partnership?3.) Are there any tax advantages in an LLC, like deducting the time from my husband he will be working at the investment property, which I believe will not be possible as with a sole Proprietor, but I am not sure?Any help will be greatly appreciated. Thank you!

LLC created is considered as separate entity in the eyes of law. You can enjoy following advantage for creating separate entity:



1. Loss from the business can be carry forward for more numer of years.



2. Salaries can be paid to partners which is deductible expenses for partnership firm, it is also deductible if you form 'S' corp.



3. You can still file a joint return as an Individual for husban & wife.

What is the best way to go to become an LLC? If I become an LLC, does that mean I have to get an accountant?

Abi,



It doesn't mean you must go to accountant but what I believe is rather than spending time in such complicated thing it's always better to tkae expert's services. Many times it happen experts can save more taxes and you can spend your research time in your core business activities that helps to to earn mor $$$.

You should talk to an accountant and an attorney about what is best for you. The consultation should be free. Here is a link 50 state guide for starting a business. http://homebizseo.com/50states...

In the guide is a link to the Secretary of State office for each state. The Secretary of State handles the LLC filings. You need to send an email with all questions that you have. It is important that you start your business correct.
