Intuit ProLine EasyCollect - Violates Circular 230?

I received a postcard from you inviting me to subscribe to your ProLine EasyCollect program, in which my preparation fee is automatically taken from the client’s tax refund. However, since payment of my preparation fee is contingent upon the refund, isn’t this a violation of section 10.27(b)(1) of IRS Circular 230 (Rev. 4-2008), which states: “Except as provided in paragraphs (b)(2), (3), and (4) of this section, a practitioner may not charge a contingent fee for services rendered in connection with any matter before the Internal Revenue Service.”? Paragraphs (b)(2), (3) and (4) involve an IRS audit, a claim for refund of interest or penalties, and a judicial proceeding, respectively.

Intuit ProLine Easy Collect is using the bank product Refund Transfer to collect fees and is not in violation of the Circular 230. More information on the service is available here:

I checked with the IRS regarding this issue, and received the following answer via email:

“We have consulted with Chief Counsel which agrees with OPR: A practitioner's use of this software does not constitute a prohibited contingent fee in violation of section 10.27(b) of Circular 230. This advice is authoritative. The opinion was delivered orally to our deputy director and to me."

ProLine Easy Collect does not currently integrate with Intuit ProLine Tax Online Edition.  Many things are planned for inclusion for the future, and one of our top priorities will be integrating with other Intuit applications to provide an end to end suite of service software.

However, these modifications likely will not take place until tax year 2010 or later.
