Does a NYS estate return have to be filed for 2010 since the federal estate tax was not in effect for that year?

I have gone on various searches but can't seem to find an answer to this (what should be straight forward)

Does an estate return have to be filed for 2010 in New York State since there was no federal estate tax during 2010 for those who died?

The estate is over the $1,000,000 exemption.

A personal client was asking me (they have a lawyer handling the estate, but she just had a question for me)

Where, pray tell, did you look? I found this in 30 seconds:

A New York estate tax return is required where a federal return is required, or where the gross estate exceeds $1 million. [ N.Y. Tax Law §971(a)(1) ; N.Y. Tax Law §951(a) .]

The answer is yes A NYS estate tax return needs to be filed.

The more I know, the more I don't know.

The search I did was on the new york state Dept of taxation website

I read it wromg, they are saying that one has to be filed even if the IRS form 706 does not need to be submitted by the estate
