On my test return, that "critical diagnostic" doesn't prevent the e-file from creating. I believe it's actually informational in nature.

You can use the expenses for child care, but only those paid before the kid turned 14.
If you use Pro Series Basic I might not be able to help you. If you use Turbo Tax I might refuse to help you. All others, watch out! ;-)
