Am I stupid--child care-not for profit

ProSeries : 2011

even if you are a not for profit child care provider--are your clients not entitled to child care credit? this is a seperate pre-school provided by a individual on church grounds

she claims clients not entitled--because she is not for profit

forgive the stupidity--but should she not also have an EIN-apparently has employees-only ID number she has produced is possibly a state number-been chasing this for a week--evidently this operation involves over 100 kids-I'm "perturbed"

If I am busy doing nothing--how do I know when I'm done?????????

The solution

Her non-profit status has absolutely nothing to do with whether child care payments to her qualify for credit or deduction.  Sounds to me like a rogue operation of some kind. Tell her that if she refuses to provide her EIN, you'll obtain it from the NPO branch of the IRS. Heck, half the churches in the country run child-care facilities.

Morons. I've got MORONS on my team. Nobody is going to rob us going DOWN the mountain. We have got no MONEY going DOWN the mountain. When we HAVE GOT the money, goin' back UP the mountain, THEN you can sweat.

Definitely entitled to child care credit.  Put "TAXEXEMPT" in the field for Fed ID.

Another note - If it's really a nonprofit, they have to make the 990 available for public view when requested.  Federal ID is on that.

I would request a copy of that Form 990.  Sounds to me like she is not reporting receipts according to IRS rulings.  They don't like very much.

If she is operating a daycare center on church grounds, the church bears a responsibility for the business. Ask the church to give you either her EIN or theirs.

When anyone doing nothing needs help, I will gladly help that person do nothing.

But if it is operating on church property, he and/or the deacons/board/ whomever runs the church are exposing themselves to, if nothing more, the bad publicity when this rogue operation blows up in the local paper.  And 100 kids-there must be staff, too.  Wonder what other laws are being broken.

i totally agree--but i always give folks an opportunity to "rectify" "honest" mistakes--this person is down to their last chance

i don't believe the minister has an active culpability here-he's let this individual provide a service that benefits his congregation-the church probably receives some rent-he indicated that he would like to know-just not be forced into involving himself as the bad guy right now-he understands that it reflects on him

quite honestly I had this exact same situation with a public school "latchkey" program--after speaking with the school system attorney and a personal  request from the director of the program for info--they issued an apology to all the parents and included copies of the info I had sent that they could take the credit

I agree the minister doesn't have active culpability, but when something goes wrong he and the church are going to look bad, if nothing else.  And he's on notice now that something doesn't smell right.

Recruit someone to go down to the daycare center with you and introduce them as an IRS agent.  Have your recruit inform her that she has 24 hours to provide the info or he will be forced to invoke code 666.a(2)c3-.1 which would give him the power to shut her business down immediately.  Either that or tell her you are going to take out a full page ad in the local paper saying that the daycare center has the worst lice infestation that the state has ever seen.
